Atom Limousine – Terms & Conditions

These Terms & Conditions (“Terms”) govern all reservations and services provided by Atom Limousine LLC (“Atom Limousine,” “we,” “us,” “our”). By booking and/or using our services, the client (“you,” “your,” “party”) agrees to these Terms.

1. Reservations & Payments

     1.1 Reservation Fee

A non-refundable reservation fee of $195 is required to secure your date and vehicle. Your booking is not confirmed until this fee is received and you receive written confirmation from Atom Limousine.

     1.2 Remaining Balance

Unless otherwise agreed in writing, the remaining balance is due no later than 72 hours before the scheduled pickup time.If full payment is not received by the deadline, we reserve the right to cancel the reservation and retain the reservation fee.

     1.3 Payment Methods

We accept major credit/debit cards and other methods as specified on our website or invoice. A valid credit card must be kept on file for incidentals, overtime, damage, and additional charges.

2. Changes, Cancellations & Refunds

     2.1 Client Cancellations

• The $195 reservation fee is non-refundable under all circumstances.
• If you cancel more than 7 days before the event, any additional payments (beyond the reservation fee) may be refunded at Atom Limousine’s discretion.
• If you cancel within 7 days of the event, all payments made are non-refundable.

     2.2 Changes to Date, Time, or Route

We will make reasonable efforts to accommodate changes to date, time, or route, subject to vehicle and chauffeur availability. Rate adjustments and additional fees may apply. Changes are only valid once confirmed in writing by Atom Limousine.

     2.3 Company Cancellations

In the rare event that Atom Limousine must cancel due to vehicle failure, safety concerns, severe weather, or other conditions beyond our control, we will:

• Make reasonable efforts to provide a comparable replacement vehicle, or
• Offer a refund of all amounts paid (including the reservation fee), which shall be your sole and exclusive remedy.

3. Use of Vehicle & Client Responsibilities

     3.1 Condition of Vehicle

Atom Limousine provides vehicles in clean, premium condition with functioning amenities at the start of service. Please inspect the vehicle upon arrival and notify the chauffeur immediately of any concerns.

     3.2 Conduct on Board

You and your guests agree to:

• Follow all instructions from the chauffeur.
• Comply with all applicable laws and regulations (including alcohol and noise ordinances). 
• Refrain from any behavior that is unsafe, abusive, or could cause damage to the vehicle or equipment.

     3.3 Right to Terminate Service

Atom Limousine reserves the right, at the chauffeur’s discretion, to end the trip immediately without refund if:

• Illegal activity is observed (including underage drinking or drug use);
• Behavior becomes unsafe, aggressive, or threatens passengers, chauffeur, or vehicle;
• Any guest ignores safety instructions or engages in reckless conduct. 

4. Alcohol, Smoking & Prohibited Substances

     4.1 Alcohol

• Alcoholic beverages may be brought on board by guests 21 years of age or older, where permitted by law.
• Atom Limousine does not provide or sell alcohol.
• Under no circumstances is underage drinking allowed. You are responsible for ensuring all guests consuming alcohol are 21+. 

     4.2 Drugs & Illegal Substances

The possession, use, or distribution of illegal drugs or substances is strictly prohibited. Discovery of such substances may result in immediate termination of the trip without refund and possible notification of law enforcement.

     4.3 No Smoking / Vaping

Smoking or vaping of any kind (including cigarettes, cigars, e-cigarettes, and similar products) is not permitted inside the vehicle. Violation may result in:

• Immediate termination of the trip;
• A cleaning/deodorizing fee, minimum $250, charged to the card on file. 

5. Damage, Cleaning & Extra Charges

     5.1 Responsibility for Damage

You are fully responsible for any damage to the vehicle and its equipment caused by you or your guests, whether accidental or intentional. This includes, but is not limited to:

• Tears, stains, burns, or breakage of seats, panels, windows, bar areas, or electronics;
• Damage to lighting, sound system, TV screens, or interior features;
• Excessive spills, bodily fluids, or any condition requiring special cleaning or repair. 

The cost of repair or replacement, plus any related downtime of the vehicle, will be charged to the credit card on file.

     5.2 Cleaning Fees

If the vehicle requires more than standard cleaning after your event (e.g., excessive trash, spills, glitter, confetti, bodily fluids), a minimum cleaning fee will apply.

• Standard excessive cleaning fee: from $250, depending on the extent of cleaning required.

     5.3 Overtime Charges

If your event extends beyond the contracted time, overtime will be billed in hourly increments (or part thereof) at the rate specified in your reservation or invoice. Overtime is subject to vehicle and chauffeur availability, and cannot be guaranteed. 

6. Routes, Delays & Waiting Time

     6.1 Route & Stops

Your route and planned stops should be communicated in advance. While we will make reasonable efforts to accommodate additional or last-minute stops, they may result in extra time and charges.

     6.2 Traffic & Delays

Atom Limousine is not responsible for delays caused by traffic, road conditions, accidents, weather, or circumstances beyond our control. We recommend allowing extra time when planning time-sensitive arrivals (e.g., ceremonies, concerts, games). 

     6.3 Waiting Time

Waiting time due to late passengers or extended stops may count toward your contracted hours and/or incur additional fees in accordance with your reservation.

7. Capacity & Safety

     7.1 Passenger Limits

The number of passengers may not exceed the legal capacity of the vehicle. The chauffeur may refuse boarding to additional guests beyond the agreed capacity. 

     7.2 Safety Rules

For safety, we strongly recommend that guests remain seated while the vehicle is in motion, except where the design allows for safe standing or limited movement. The chauffeur may temporarily stop the vehicle if guest behavior becomes unsafe.

8. Personal Property

Atom Limousine is not responsible for any loss, theft, or damage to personal property brought on board or left in the vehicle, before, during, or after the service. Please check the vehicle carefully before final drop-off.

9. Photography & Marketing

With your consent, Atom Limousine may take interior photos or short clips of the setup (never showing faces without permission) to use for marketing and social media. If you do not wish any photos/video to be taken or used, please inform us in writing prior to your event.

10. Force Majeure

Atom Limousine shall not be liable for any failure to perform or delays due to causes beyond its reasonable control, including but not limited to acts of God, severe weather, government orders, strikes, civil unrest, or mechanical breakdowns that could not be reasonably prevented.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas. Any disputes arising from these Terms or our services shall be brought in the appropriate courts located in Travis County, Texas, unless otherwise required by law.

12. Acceptance of Terms

By paying the reservation fee and/or using Atom Limousine services, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
